PRIVACY NOTICE

Notice of Privacy Practices of Accurate Neuromonitoring 

This notice describes: 

  • How health information about you may be used and disclosed 
  • Your rights with respect to your health information 
  • How to file a complaint concerning a violation of the privacy or security of your health information, or of your rights concerning your information

Your Rights 

You have the right to: 

  • Request restrictions on the use and disclosure of your protected health information 
  • Receive confidential communications concerning your medical condition and treatment 
  • Inspect and copy your protected health information 
  • Amend or submit corrections to your protected health information 
  • Receive an accounting of how and to whom your protected health information has been disclosed 
  • Get a list of those with whom we’ve shared your electronic records 
  • Get a list of health care providers who have received your information through certain third parties (such as health information exchanges) 
  • Choose in advance whether to receive fundraising communications 
  • Get a copy of this privacy notice in paper or electronic form 
  • Discuss this notice with our Privacy Officer 
  • File a complaint if you believe your privacy rights have been violated 

Your Rights Explained 

Request restrictions on use and disclosure 

  • You can ask us not to use or share certain health information for treatment, payment, or our health care operations. We are not required to agree to your request, and we may say “no” if it could affect your care. 
  • If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information with your health insurer for payment or health care operations purposes. We will say “yes” unless a law requires us to share that information. 

Receive confidential communications 

You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address. We will accommodate all reasonable requests. 

Inspect and copy your records 

You may inspect or copy the protected health information that we maintain. We require that requests be submitted in writing. Contact our Privacy Officer to obtain a request form. Your request will generally be approved unless there are legal or medical reasons to deny it. 

Amend your records 

You can ask us to amend your health information if you believe it is incorrect or incomplete. We may say “no” to your request, but we’ll explain why in writing within 60 days. 

Receive an accounting of disclosures 

You can ask for a list of the times we’ve shared your health information for purposes other than treatment, payment, health care operations, and certain other activities. We will provide one accounting per year for free but may charge a reasonable fee for additional requests. 

Get a list of electronic disclosures 

You can request a list of those with whom we’ve shared your electronic health records. 

Opt out of fundraising communications 

You have the right to advance notice of, and the ability to opt out of, fundraising communications from us. 

Get a copy of this notice 

You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly. 

Discuss this notice 

You can ask questions or obtain more information about this notice and our privacy practices by contacting our Privacy Officer. 

File a complaint 

You can complain if you feel we have violated your rights by contacting us at the address below. 

You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by:

We will not retaliate against you for filing a complaint. 

Our Uses and Disclosures 

 

How do we typically use or share your health information? 

We use and share your health information in the following ways: 

Treatment 

Your health information may be used by staff members or disclosed to other health care professionals for the purpose of evaluating your health, diagnosing medical conditions, and providing treatment. 

Example: Results of tests performed during a procedure will be available in your medical record to all health professionals who may provide treatment or who may be consulted by staff members. 

Payment 

Your health information may be used to seek payment from your health plan, an automobile insurer, a workers’ compensation board, or from other third-party sources that may provide payment for services. 

Example: Your health plan may request and receive information on dates of service, the services provided, and the medical condition being treated. 

Health care operations 

Your health information may be used as necessary to support the day-to-day activities and management of Accurate Neuromonitoring. 

Example: Information on the services you received may be used to support budgeting and financial reporting, and activities to evaluate and promote quality. 

How else can we use or share your health information? 

We are allowed or required to share your information in other ways—usually in ways that contribute to the public good, such as public health and research. We have to meet many conditions in the law before we can share your information for these purposes. 

Public health and safety 

We can share health information about you for certain situations such as: 

  • Preventing disease 
  • Reporting adverse reactions to medications 
  • Reporting suspected abuse, neglect, or domestic violence 
  • Preventing or reducing a serious threat to anyone’s health or safety 
  • Assisting the FDA with product recalls and safety notifications 

Medical emergencies 

We can share your information during a medical emergency with personnel and health care providers responding to the emergency. 

Research 

We can use or share your information for health research under certain conditions. 

Comply with the law 

We will share information about you if state or federal law requires it, including with the Department of Health and Human Services if it wants to see that we’re complying with federal privacy law. 

Law enforcement 

We can share health information with law enforcement officials for law enforcement purposes, to support government audits and inspections, to facilitate law-enforcement investigations, and to comply with government-mandated reporting. 

Respond to lawsuits and legal actions 

We can share health information about you in response to a court or administrative order, or in response to a subpoena. 

Audits and oversight activities 

We can share your information with oversight agencies for activities authorized by law, including audits, investigations, and inspections. 

Workers’ compensation 

We can use or share health information about you for workers’ compensation claims. 

Other uses and disclosures require your authorization 

Disclosure of your health information or its use for any purpose other than those listed above requires your specific written authorization. If you change your mind after authorizing a use or disclosure, you may submit a written revocation of the authorization. However, your decision to revoke the authorization will not affect or undo any use or disclosure that occurred before you notified us. 

Personal representative 

If someone has legal authority to act on your behalf, such as a person with your medical power of attorney or a legal guardian, that person can exercise your rights and make choices about your health information. We will verify that the person has this authority before taking action. 

Additional Uses of Information 

Appointment reminders and notifications 

Your health information may be used by our staff to send you assignment reminders and payment notices. 

Our Responsibilities 

  • We are required by law to maintain the privacy and security of your protected health information. 
  • We must let you know promptly if a breach occurs that may have compromised the privacy or security of your information. 
  • We must follow the duties and privacy practices described in this notice and give you a copy of it. 
  • We will not use or share your information other than as described in this notice unless you tell us we can in writing. If you tell us we can, you may change your mind at any time by letting us know in writing. 

Changes to the Terms of this Notice 

We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request in our office and on our website at www.accurateneuromonitoring.com.

ADDENDUM A 
State-Specific Privacy Rights — Neurophysiologic Interpretive Medicine PLLC
This addendum applies to patients receiving services from Neurophysiologic Interpretive Medicine PLLC in New York. Where New York law provides greater protections than HIPAA, New York law controls.
New York 
Patient Access to Medical Records (N.Y. Public Health Law §18)
Under New York law, you have the right to inspect and obtain copies of your medical records. Requests are generally fulfilled within 10 days (paper) or 5 days (electronic). A reasonable fee may be charged. If access is denied, you have the right to request a review of that decision by a designated reviewing physician.
